<p>Leggo su [$noto_social] di un tizio che sostiene (ovviamente dolendosi del fatto che i media mainstream non ne facciano – chissà come mai – motto alcuno) che ieri innanzi al Tribunale di Trento (Trento? Perchè Trento?) vi sarebbe stata la prima udienza (la prima udienza ??) del processo a carico del Capo dello Stato (il Capo dello Stato!!!) per il delitto di attentato a corpo politico e robe del genere (attentato-a-corpo-politico!!!). Ovviamente stiamo parlando della storia, ormai diventata anche un poco stucchevole dei vaccini e dei pass, che violerebbero nientedimeno che la Costituzione (da cui il reato commesso dal Presidente). Fattogli garbatamente notare che si tratta di una strASSURDITA’ BELLA E BUONA, mi si replica: e se non lo fosse?</p>
<p>Lo è, lo è: il Capo dello Stato gode di immunità per i reati commessi nell’esercizio delle funzioni, eccetto che per alto tradimento e attentato alla costituzione (reati da definiti da nessuna parte, ma pazienza), deve esser messo in stato di accusa dal Parlamento in seduta comune e giudicato dalla Corte costituzionale integrata e costituita come Alta Corte di giustizia. </p>
<p>E chi lo dice? Proprio quella Costituzione a cui tanto ti aggrappi…(quando e nella parte che ti comoda).</p>

<p>Nell’articolo precedente ho cercato di evitare come la peste il termine “norma”. Lo ho fatto perché nel mondo del diritto questa parola ha un significato tecnico molto specifico, e non la si deve usare in modo non corretto. Tutti noi, quando leggiamo oppure ascoltiamo qualcosa, gli attribuiamo un significato; questa operazione si chiama “interpretazione” ed è inevitabile. Ne deriva che può esserci, proprio per effetto della interpretazione una differenza tra quello che si voleva dire e quello che è stato capito, quindi giova chiamare le due cose in modo diverso. Quello che dico si chiama “enunciato”, quello che tu hai interpretato si chiama “proposizione”. Non sfuggono a questo problema quei particolari enunciati che sono le leggi. In questo caso l’enunciato assume il nome di “disposizione” e la regola che se ne estrae tramite la interpretazione è la “norma”. Se riusciamo a capire questo abbiamo fatto un bel passo avanti.</p>

<p>Per cominciare racconto una storiella stupida in tema con l’estate che si avvia alla conclusione: giorni fa mi sono seduto nei tavolini all’aperto, il cosiddetto “dehors” di una (giustamente) nota gelateria di Loano, che prima inspiegabilmente non lo aveva e che lo ha istituito giusto in occasione della epidemia. Finalmente, direi, perchè a me piace gustare il gelato comodamente seduto e senza dover prima partecipare a una sorta di assalto al forno delle grucce. Appena mi seggo, noto un cartello, che vieta di usare il dehors per consumare coni e coppette. Mi pare giusto, ma subito dopo un altro cartello mi ammonisce che non si fa servizio al tavolo. Scatta il cortocircuito interpretativo delle due disposizioni: se non si fa servizio al tavolo, allora devo mettermi in coda con gli altri per prendere al banco un cono o una coppetta, che però poi a quel punto non potrei consumare nel dehors. La sola possibilità interpretativa è che si debba comprare al banco qualcosa che non sia nè cono nè coppetta. In realtà il sistema era più complesso: occorreva fare in autonomia la ordinazione presso una cassa riservata ai clienti del dehors che poi venivano dotati di un apposito apparecchio, che si metteva a strillare quando il tuo gelato era pronto e tu te lo dovevi andare a prendere. Solo che questo non era spiegato da nessuna parte ed io ho dovuto industriarmi non poco per ottenere questa informazione. Nel mentre, un sacco di gente veniva cacciata dal dehors perchè stava mangiando un cono e molta altra se ne andava perchè dopo mezz’ora di attesa nessuno era venuto a prendere l’ordinazione. Ecco è solo una storiella, ma mi serve per dire che disposizioni fatte male sono in grado di rendere difficile anche mangiare un gelato. Figurarsi governare una nazione.</p>
